Terms of Service

These terms cover your use of Spice-ey: the spice-ey.com website, the Console, the Spice-ey for Business app, the point-of-sale, kitchen-display and courier apps, and the ordering sites (“storefronts”) that businesses run on Spice-ey.

Last updated: 5 October 2026

Spice-ey is a product of D Y K, a limited liability company registered in Egypt (Commercial Registry No. 20322, 6th of October Investment Office; Tax Registration No. 667-383-212), at 6 Gezerit El Arab Street, Mohandessin, Giza (“Spice-ey”, “we”, “us”).

By using Spice-ey, you agree to these terms. If you use Spice-ey for a business, our Merchant Agreement also applies, and it governs where the two differ. Our Privacy Policy explains how we handle personal information.

1. Who does what

  • Businesses (“merchants”) use Spice-ey to run their menus, orders, kitchens, payment records and customer tools. Each merchant sells its own products. It sets its own prices, delivery areas and policies, and it is responsible for them.
  • Customers order from a merchant on that merchant’s storefront. Your order is a contract between you and the merchant. Spice-ey provides the software. We are not the seller, the restaurant or the courier.
  • Staff and couriers use Spice-ey with the access their merchant gives them.

2. Accounts

  • Give accurate information and keep it up to date.
  • Keep your password, PIN and one-time codes to yourself. Each staff member should have their own sign-in or PIN.
  • You are responsible for what happens under your account until you tell us it has been misused. If you think it has, write to hello@spice-ey.com straight away.
  • We may confirm your phone number or email with a one-time code sent by WhatsApp, SMS or email.
  • You must be legally able to enter a contract. A customer who isn’t yet able to may use a storefront account with a parent’s or guardian’s involvement where the law requires it.

3. Ordering from a merchant

These points are for customers.

  • The merchant decides what it sells, its prices and fees, when it’s open, where it delivers, its estimated times and whether it accepts your order.
  • Prices: the amounts at checkout are the merchant’s.
  • Payment goes to the merchant. Depending on what the merchant offers, you can pay in cash, by card through the merchant’s own payment provider, or by InstaPay or bank transfer to the merchant’s account. Spice-ey doesn’t receive or hold that money. If you upload a transfer receipt, the merchant checks it before accepting your order.
  • Problems with an order: cancellations, refunds, complaints, allergies and food safety are the merchant’s to handle. Use the contact details on the merchant’s storefront. We can help with technical problems on the ordering site.
  • Your storefront account keeps your profile and saved addresses ready on any Spice-ey storefront. Your orders stay separate for each merchant, as section 4 of the Privacy Policy explains.

4. Acceptable use

Don’t use Spice-ey to:

  • break the law, or sell anything illegal or anything you aren’t licensed to sell;
  • publish content that is false, misleading, infringing, hateful or harmful, or that you don’t have the rights to;
  • send spam, or messages people haven’t agreed to receive;
  • try to reach another business’s data, test or break our security, overload the service, or get around its limits;
  • copy, scrape or resell Spice-ey, or reverse-engineer it except where the law allows;
  • use bots or automated access, except through tools we provide for it (such as agent access) and within their limits;
  • pretend to be someone else, or misstate your link to a business.

We may remove content, and suspend or close accounts, that break these rules (section 10).

5. AI features

  • What they do. Some features use AI models to read, write or suggest: menu import from photos, PDFs and spreadsheets; English–Arabic translation and descriptions; the owner brief and assistant; draft replies to reviews, and campaign drafts.
  • AI can be wrong. Check what it produces before you publish or rely on it, especially prices, ingredients, allergens and anything said to customers.
  • How your content is used. To run a feature, we send the content you give it to our AI provider. The provider processes it on our behalf under contract, and doesn’t use it to train its models.
  • Limits. AI features may have usage allowances that depend on the plan.

6. Content and intellectual property

  • Ours. Spice-ey — the software, design, brand and documentation — belongs to D Y K and its licensors. We give you a limited, non-exclusive, non-transferable right to use it under these terms.
  • Yours. Your content stays yours: menus, photos, logos, descriptions and anything else you upload. You let us host, copy, process, display and adapt it to run Spice-ey for you and as you direct. For example, we resize your photos, translate your menu and show it on your storefront.
  • Feedback. If you send us ideas or feedback, we may use them without any obligation to you.

7. Services run by others

Spice-ey connects to services run by others, such as payment providers like Paymob, WhatsApp and SMS providers, maps, app stores, review sites and delivery platforms. Their own terms apply when you use them, and we aren’t responsible for their availability or what they do. If you download our apps from the App Store or Google Play, that store’s terms apply too.

8. Availability and changes

  • Availability. We work to keep Spice-ey available, secure and fast, but we can’t promise it will never be interrupted or have errors. Maintenance, internet or provider outages, and events outside our control can interrupt it. We announce planned maintenance when we reasonably can.
  • Changes. We improve Spice-ey continually and may add, change or remove features. The Merchant Agreement says what happens if a change takes away a core part of a paid plan.
  • Early features. Features marked beta, preview or pilot may change or stop, and are provided as they are.

9. Disclaimers and liability

  • To the extent the law allows, and except as these terms or the Merchant Agreement say otherwise, Spice-ey is provided “as is” and “as available”.
  • We aren’t responsible for a merchant’s products, service, prices, delivery or policies, or for disputes between merchants and their customers.
  • To the extent the law allows, we aren’t liable for indirect or consequential loss, or for lost profit, revenue or data, and our total liability to a customer or visitor for all claims is limited to EGP 1,000. Our liability to merchants is set in the Merchant Agreement.
  • Nothing in these terms limits liability for fraud or gross negligence. Nor does it limit any right or liability that Egyptian law doesn’t allow to be limited, including consumer-protection rights.

10. Suspension and closing accounts

  • You can stop using Spice-ey at any time. To delete your account, follow the steps on our account deletion page.
  • We may suspend or close an account, or remove content, if it breaks these terms or the law, if it puts people or the platform at risk, or if a court or authority requires it. Where it’s reasonable, we tell you first and give you a chance to put it right.

11. Changes to these terms

We may update these terms, and the date at the top shows the current version. For a material change, we give notice on the site, in the Console or by email before it takes effect. For businesses, that is at least 30 days’ notice. If you keep using Spice-ey after the change takes effect, you accept the updated terms.

12. Law and disputes

  • These terms are governed by the laws of the Arab Republic of Egypt.
  • If something goes wrong, contact us first so we can try to resolve it.
  • If it isn’t resolved within 30 days, the competent courts of Giza have jurisdiction. This doesn’t limit a consumer’s right to go to any court or authority the law allows.

13. Language

These terms are written in English and are also published in Arabic. Where Egyptian law requires the Arabic text, as it does for consumers, the Arabic version prevails. Otherwise, the English version prevails.
